Woman was fired by company for using annual leave as reward

Recently, in Guangzhou, Guangdong, Lv Moumou joined a company in 2021 as the head of pharmacists, responsible for managing the pharmacist sales team. In order to motivate employees, Lv Moumou used annual leave as a prize for the annual meeting lottery without the company's approval. At the annual meeting, some employees won annual leave ranging from 3 to 7 days. After the company discovered Lv Moumou's behavior, it fired him on the grounds of "abusing power for personal gain."

In September 2023, Lv filed a labor arbitration, requesting the company to pay compensation of 328,349.28 yuan. In December 2023, the arbitration committee ruled that the company should pay Lv a lump sum of 228,492 yuan in compensation. The company was dissatisfied with the ruling and filed a lawsuit with the court. After trial, the court held that the company failed to provide sufficient evidence to prove that Lv had committed "abuse of power for personal gain" and other violations, and that the labor relationship should be terminated illegally. The court ruled that the company should pay a lump sum of 228,492 yuan in compensation and rejected all the company's claims.
